PREVENTION OF SEXUAL HARASSMENT (POSH) - I believe that while dealing with POSH matters, one needs to be very precise and aware of evolving practices that need to be put in order. In times of corporate culture, which, if left unaddressed, can lead to disastrous consequences and can bring down the public reputation of any firm.
PREVENTION OF SEXUAL HARASSMENT OF WOMEN AT WORKPLACE (PREVENTION, PROHIBITION AND REDRESSAL) ACT, 2013 is a Legislative Act in India that seeks to protect women from Sexual Harassment at their place of work. The Act came into force on 9 December 2013. The act was the result of the Vishaka guidelines which were laid down by the Supreme Court of India in the matter of Vishakha and Others vs State of Rajasthan. Hence after the enactment of this Act, this statute superseded the Vishaka Guidelines for Prevention Of Sexual Harassment (POSH) introduced by the Supreme Court (SC) of India.
The Act will ensure that women are protected against sexual harassment at all work places, be it in public or private. The scope and aim of this act was establishing equality in working conditions everywhere by instilling a sense of security at the workplace designed to improve women's participation in work, resulting in their economic empowerment and inclusive growth.
That the Act envisaged setting up of internal committees at every office of the organisation and by virtue of Section 4, every Employer shall constitute an “Internal Complaints Committee” failing which it may result in liable to pay a fine and cancellation of license or registration, as the case may be.
